Let me give you two examples. The first is a Star Wars
themed game. If you started a SW mud that wasn't
commercial, then I don't think too many people would
make comments about "Intellectual Property". This is
because Lucas is known to be pretty ok with that
sort of thing.
On the other hand, if you were to make a World of
Warcraft themed mud, you might get some warnings. This
is because Blizzard is known to have a very aggressive
zero-tolerance policy toward games based on their IP.
You'd be living on borrowed time til they got wind of
you, and sent their lawyers your way.
It sounds like you have no idea if the owner of the
IP cares about this stuff. That is probably a mistake.
You should know, one way or another, before you start.
My post is not intended to judge your rightness or
wrongness. It's just an explanation that you seem to
be assuming that all IP is handled the same, but
in fact you need to be a little more aware of the
IP holders' stance on people using it.
